Commercial establishments refer to places involved in commercial work, trading, banking, insurance, and Establishment or Administrative services. Furthermore, these can also include theatres or other public amusement or entertainment facilities. The State government can also declare a specific space as a commercial establishment for this Act through the necessary protocols. Shops, on the other hand, refer to premises or locations where business or trade take place or services provided to consumers. These are offices, storerooms, godowns, warehouses, etc.
Unlike previously, when all interactions with the labour department were dealt with through the Labour office, the implementation of the website made the process a lot easier. Most people starting up a business has to continuously interact with the office and it now seemed easier, if this were handled through the internet, over making multiple trips back and forth. Shops and establishments have to mandatorily apply for a shop licence if they are planning on running an establishment in Karnataka.
The Labour Department is an Online Facility for the registration of businesses, issues relating to licences and renewals, and amendments to registrations and licences in connection with multiple Acts. These were connected to the State or Central Labour Laws and Rules that are enforced by the Labour Department, Government of Karnataka.
Some of the tasks performed through the online portal by business owners are:
* Issuing Registration Certificate
* Renewal of Registration Certificate
* Facilitating changes in Registration Certificate
* Issuing Duplicate Registration Certificate
* Annual Returns Filing
* Exemption or relief weekly holidays
* Exemption for Women working in Night Shifts
* Appeal submission
According to the Karnataka, Department of Labour, the amount spent on licences to run specific shops or establishments vary significantly depending on the number of people working there. There are additional factors that come into play, as well.
With the introduction of the shop’s licence or Gumasta licence, business owners had to make
sure they were following the right guidelines when they were running an establishment. Some of
the duties they have to comply with are
* Registering the organisation
* Fixing work hours and weekly holidays
* Creating proper employment and regulation guidelines
* Maintaining the records of the management
For the registration or renewal of shops or establishments under the Karnataka Shop, and
Commercial Establishment Act, 1961 entrepreneurs can choose to use one of the many reputed
websites to get this done.
* In case of a new registration, register the organisation within 30 days from the date of
commencement.
* The registration certificate is valid for five years and should be renewed before the expiry
date by paying the necessary fees.
* Business owners have to display the registration certificate in a place where everyone
can see it within the office premises.
* If any information has to be changed, such changes should be notified in the prescribed
format to the registration authority.
* After closing the business establishment, the owner should submit the registration
certificate back to the authority.
